Who we are #

These terms are an agreement between you and Peaknode Labs LLC (“Peaknode”, “we”, “us”). “You” means the organization that creates an account and the people who use Peaknode on its behalf. By creating an account or using the service, you accept these terms. If you accept them for an organization, you confirm you are authorized to do so.

The service #

Peaknode is software for proof of reserves. It lets you:

  • prove control of wallet addresses by signing challenges with their keys;
  • commit your customer liabilities in a Merkle tree, with optional zero-knowledge proofs;
  • read the balances of your wallets directly from public blockchains; and
  • combine the three into a proof of reserves at recorded block heights.

We provide the service through the dashboard at app.peaknode.ar and the API at api.peaknode.ar.

What a proof is, and what it is not #

A Peaknode proof is a cryptographic statement about the wallets and liability data you submit, at the block heights it records. It shows that keys controlling the submitted wallets signed our challenges, that the committed liabilities match the data you provided, and whether on-chain balances at those heights covered them.

A proof is not a financial audit, an assurance or attestation engagement, a legal opinion, or a guarantee of solvency. It does not cover liabilities you leave out, assets held off-chain, obligations to anyone not in your data, or events after the recorded block heights. Do not describe a Peaknode proof as an audit or as a guarantee by Peaknode.

Your data and your responsibilities #

You own the data you submit. You allow us to process it only to provide the service to you, as described in our Privacy Policy.

You are responsible for:

  • the accuracy and completeness of the liability data you submit;
  • having the rights and consents needed to share that data with us, including any customer information in it;
  • how you describe and share proofs with your customers, regulators, and the public; and
  • keeping your wallet keys under your control. Peaknode never asks for private keys and never moves funds.

Acceptable use #

You agree not to:

  • submit data you know to be false or use a proof to mislead anyone;
  • try to access another organization’s data, or test the service’s security without permission, except as our vulnerability disclosure policy allows;
  • disrupt the service, deliberately exceed rate limits, or automate access in ways that degrade it for others;
  • reverse engineer the service except where the law allows it; or
  • use the service in breach of sanctions, anti-money-laundering rules, or other applicable law.

Accounts and credentials #

Keep passwords, multi-factor devices, and API keys secure. Tell us promptly at [email protected] if you think one is compromised. You are responsible for activity under your accounts and keys until you revoke them.

Availability and changes #

We work to keep the service available but do not commit to a level of uptime unless a separate written agreement does. Current status is published at status.peaknode.ar. We may change or retire features; when a change materially reduces the service, we will give reasonable notice where we can.

Fees #

Fees, if any, are set in a separate order form or agreement.

Intellectual property #

Peaknode, the software, and our documentation belong to Peaknode Labs LLC. While your account is active, we grant you a limited, non-exclusive, non-transferable right to use the service under these terms. We may use feedback you send us without obligation to you.

Disclaimer of warranties #

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that proofs are free of errors caused by the data you submit, by blockchain data providers, or by third-party networks.

Limitation of liability #

To the fullest extent the law allows, Peaknode Labs LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that the law does not allow to be limited.

Indemnity #

You will defend and indemnify Peaknode Labs LLC against third-party claims arising from the data you submit, from your statements about proofs, or from your breach of these terms.

Suspension and termination #

You may stop using the service and close your account at any time. We may suspend or end access if you breach these terms, if the law requires it, or if your use puts the service or other customers at risk. Where reasonable, we will tell you first and give you a chance to fix the problem. When an account closes, we handle its data as the Privacy Policy describes.

Governing law #

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules. The governing law is not final and may change before these terms are finalized.

Changes to these terms #

We may update these terms. We will post the new version here with a new “Last updated” date, and we will email account owners about material changes before they take effect. Continuing to use the service after that means you accept the updated terms.
